The client’s £8m mixed-use private residential and social housing scheme in London had to balance the strict requirements of multiple third parties. Stakeholders included London Underground, a housing association and several external funders.
The client was wary because mixed-use projects of a similar size had caused them difficulties in the past. Particular problems had arisen in relation to instruction and management issues, handover requirements and defects rectification.
Fenwick Elliott came on board to provide a full range of expert project support.
In collaboration with the client, Fenwick Elliott developed a number of amendments to the Joint Contract Tribunal (JCT) contract focusing on the importance of producing the necessary documentation on time, ensuring that the handover requirements for project completion were understood and adhered to and also giving consideration to the rights of tenants in terms of defect rectification after the project has been completed.
The client was provided with clear, well-drafted documentation, approved by the project stakeholders, avoiding the need for lengthy negotiations with contractors.
