Claire specialises in all major forms of dispute resolution including litigation, arbitration and adjudication as well as mediation. She has acted on a wide range of both domestic and international construction disputes including advising on a successful arbitration under the DIAC Rules in relation to a dispute arising out of the Jumeirah Village in Dubai as well as numerous domestic adjudications.

Specialist expertise

Claire has significant experience of disputes in relation to high value energy projects.

Examples of Claire’s expertise include:

  • Advising an EPC contractor in relation to an extension of time claim arising out of unforeseeable ground conditions encountered during the construction of a power station.
  • Advising an EPC contractor in relation to a dispute with their consortium partner as to liability for liquidated damages in respect of a power and desalination plant in Qatar.
  • Advising an EPC contractor in relation to their extension of time claims in respect of a power and desalination plant in Oman. The value of the claim was in excess of £100 million.
  • Acting for an EPC contractor in respect of an international adjudication for allegedly defective potable water tanks at a power and desalination plant in Qatar.
  • Acting for a horizontal drilling contractor in relation to an ICC arbitration. Dispute in excess of £100 million.

Other activities

Claire is a co-author of Mediating Construction Disputes: An Evaluation of Existing Practice which was shortlisted for the prize for best communication or publication by CEDR in its 2010 awards. Claire is currently assisting Nicholas Gould in monitoring the Cost Management Practice Direction which started in the TCC and Mercantile Courts on 1 October 2011. She also regularly contributes articles to Building Magazine’s website and speaks at Fenwick Elliott hosted seminars.
