David has a wide range of experience advising public and private sector clients in contentious and non-contentious matters, mainly relating to construction, energy and infrastructure projects.

He has over 16 years of experience advising clients in relation to standard form and bespoke contract documentation with a particular emphasis on international construction, energy and infrastructure projects and upstream and downstream oil and gas projects. David has drafted and advised on project documentation and dispute resolution for infrastructure and energy projects in the Azerbaijan, UK, Turkey, India, Kazakhstan, Korea, Pakistan, Australia, New Zealand, Europe and throughout the Middle East.

David has also advised government and commercial clients on a range of international law issues including jurisdiction, conflict of laws, bilateral and multilateral investment treaty rights, treaty interpretation, enforcement of arbitral awards and international environmental law.

Specialist expertise
David has particular expertise advising clients in large international arbitration matters including arbitrations under ICC, LCIA, ICSID and UNCITRAL rules. David has also advised clients in disputes before the English, New Zealand and Australian Courts.

David also has specialist experience of large-scale energy, oil and gas projects and power and water projects including several large-scale desalination projects. David has advised clients involved in power and water projects in Abu Dhabi, Dubai, Jordan, Kuwait, Qatar, Oman and Saudi Arabia and has advised on a number of large scale oil and gas developments in the Middle East, Caspian and CIS regions.

Examples of David’s expertise include:

  • Advising an EPC Contractor on the termination of USD5 billion gas train project in the Middle East.
  • Acting for the EPC contractor in an ICC arbitration concerning delays to a refinery project with amounts in dispute of approximately $40 million.
  • Acting for the operator of a crude oil pipeline in the Caspian region in ICC arbitration proceedings with amounts in dispute in excess of $200 million.
  • Acting for an EPC Contractor in ICC arbitration proceedings arising out of an Independent Power Water Project (IWPP) in the Middle East.
  • Advising on claims and disputes arising out of the construction of the Baku-Tbilisi-Ceyhan (BTC) Crude Oil Pipeline Project in Turkey, including ICC arbitration proceedings.
  • Advising the purchaser under a ‘take or pay’ contract for the supply of 8bcm of natural gas in a CIS country.
  • Advising a technology company on issues arising in the design and installation of a technology works package for a Middle Eastern Government with a contract value of approximately $500 million.

Other activities
David regularly speaks at conferences on issues relating to international arbitration and international construction law. David has also acted as a consultant to the Commonwealth Secretariat on international law issues and worked as a legal adviser to the Ministry of Foreign Affairs of Bahrain. David contributes articles to our quarterly newsletter International Quarterly.
