2011/2012

Our 15th Review contains our usual round up of the key developments in the construction and energy arena over the past year. This includes a summary of everything you need to know about the payment and adjudication changes introduced in October 2011. We also take the opportunity to review a number of key questions regarding the formation of your contract.

2010/2011

According to research published on 20 September 2010, by TheCityUK’s legal services and dispute resolution group, the use of arbitration and mediation in the UK has risen dramatically - almost certainly as a consequence of the current financial crisis. Our 14th Review therefore looks at the revised TCC Court Guide which came into effect at the beginning of October 2010.

2009/2010

Our 13th Review considers the latest developments in dispute resolution, highlighting Fenwick Elliott's role heading up a team to consider the use of mediation in construction projects. This research was carried out with the support of the Centre of Construction Law and Dispute Resolution at King's College, London and the Technology and Construction Court.

2008/2009

Our 12th Review considers the latest developments in dispute resolution, highlighting the increasing judicial support given to mediation and discussing the ways in which the TCC "encourages" compliance with the pre-action protocol. We also take a look back at adjudication ten years after the implementation of the Housing Grant Act and look to the future with a discussion on the proposed Government reforms to the Act.
