Contract experience

Toby has experience of all principal contracts including JCT, ICE, NEC/ECC,
I Chem E, I Mech E, GC/Works and FIDIC and a variety of bespoke forms of domestic and international contracts. He has developed a particular expertise in the NEC forms.

General experience

Toby undertakes a mix of contentious and non-contentious work. Contentious matters include substantial domestic and international construction and engineering disputes, including UK and International Chamber of Commerce arbitration, claims in the Technology & Construction Court, Adjudication and all forms of Alternative Dispute Resolution. His experience includes such issues as delay and disruption, loss and/or expense, defects, certification, professional negligence, jurisdiction and enforcement.

On the non-contentious side, Toby carries out regular tender appraisals and reviews and negotiates amendments to all the principle standard form contracts, appointments, warranties and bonds. He also advises on dispute resolution procedures for major non-contentious projects, and prepares specific amendments for the various standard forms to suit individual client's requirements.

Career

Toby gained a Geography degree at University College, London and spent a year on an EC scholarship at the University of Utrecht. He also has a first class Certificate in Construction Law and Administration. As a lawyer, Toby has specialised solely in construction and engineering issues throughout his career, firstly as a barrister from 1994 but since 1998 he has also been qualified as a solicitor. Toby worked for Addleshaw Booth and Co before joining Simmons and Simmons, where he was a senior solicitor. He joined Fenwick Elliott as an associate in June 2004, becoming a partner in April 2006.

Other activities

Toby contributed to the Standard Industry Precedents for Butterworths, and is a regular contributor to various construction publications. Toby also undertakes in house training for clients on a variety of construction topics.

Memberships

Toby is a member of the Society of Construction Law and Adjudication Society and an associate of the Chartered Institute of Arbitrators.
