May's issue of the Dispatch considers the potential consequences of a party taking a wholly unreasonable stance during a mediation.  It also examines the question of the confidentiality of arbitration proceedings.

Appointment of new Associate

The Fenwick Elliott team has been further strengthened by the arrival of Barry Hembling, who joined us as an Associate on 7 April 2008. Barry has a wealth of construction experience including most recently at Alfred McAlpine Plc where he advised all the group companies on both contentious and non contentious matters and general risk management.

We are pleased to announce the arrival of Rebecca Williams, who joined Fenwick Elliott as an Assistant Solicitor on 21 January 2008. Rebecca who has been admitted as a Solicitor in both New South Wales, Australia and England & Wales, has spent the past five years at Lane & Partners LLP working in their Construction and Litigation Group.

ICC International Centre for Expertise

We are delighted that Nicholas Gould has accepted the offer to act as chairman of the Standing Committee of the ICC International Centre for Expertise for a three year period running from 1 January 2008.

The Centre which acts as the service centre of the International Chamber of Commerce offers three distinct services, the proposal of experts, the appointment of experts and the administration of expertise proceedings. Papers from the FIDIC Contracts Conference 2007

Fenwick Elliott, jointly with Keating Chambers, hosted the FIDIC Contracts Conference 2007: Practical Legal Considerations on Major International Projects on 5 October 2007. The papers given by Jeremy Glover entitled "Roles and Relationships Within the Project: the Employer", Nicholas Gould entitled "Time Bar Clauses" and Karen Gidwani entitled "Alternatives to the Dispute Board – Project Mediation" are now available on line.

The IBC Construction Law Summer School was held at Queen’s College, Cambridge from 10-12 September 2007. The papers given by Jeremy Glover on the FIDIC Form of Contract and Simon Tolson on Design Liability are now available on line

New partner strengthens Fenwick Elliott team

We are pleased to announce the appointment of a new partner, Julie Stagg, effective from 24 September 2007. Julie, who has previously worked at Herbert Smith and SJ Berwin, joins to reinforce our projects team.

Annual Review 2007

Our 11th Review, includes articles on three of the major project forms, JCT, NEC3 and FIDIC.  There are features on the latest challenges to adjudication as well as the potential reforms to the Housing Grants legislation.  We also outline the reforms to the CDM Regulations and comment on the corporate manslaughter and corporate homicide bill which has finally received parliamentary approval.

The Review also outlines the latest developments in dispute resolution.  These include details of the TCC Mediation Survey, changes to the TCC Protocol as well as information about the new project mediation scheme which we have developed in conjunction with CEDR.

In addition, as always, the Review contains its regular round-up of the key construction cases from the past twelve months taken from the Dispatch and Construction Industry law letter.

Mediation in construction disputes: interim report released

Fenwick Elliott is assisting in the preparation of a mediation survey being carried out by King’s College, with the assistance of the Technology and Construction Court. Nicholas Gould summarises the interim results of that survey.
