Since 1 October 2011 a costs management pilot scheme has been operating in the Technology and Construction Court (the “TCC”) (together with the Mercantile Courts) and is due to complete on 30 September 2012. Nicholas Gould, a partner at Fenwick Elliott (in his capacity as a Senior Visiting Lecturer at King’s College, London) and Claire King an associate at Fenwick Elliott are amongst those monitoring the effectiveness of the pilot study. We are pleased to announce that Peter Collie joined Fenwick Elliott as a partner on 1 November 2011.

Peter, a Barrister, has over 32 years experience in the construction industry and has worked as a legal adviser on major construction and engineering projects around the world. Peter is one of only 46 people worldwide on the FIDIC President’s Panel of Adjudicators and Dispute Board Members.

The Government has finally confirmed that the amendments to the statutory payment, adjudication and suspension rules established by the HGCRA, introduced by Part 8 of the Local Democracy, Economic Development & Construction Act 2009 will take effect from 1 October 2011. The changes include extending section 107 so that the adjudication legislation applies to oral and partly oral contracts and not just contracts evidenced in writing. There are also a number of important changes to the statutory payment framework including an entirely new notice scheme and an enhanced statutory right to suspend performance in response to non-payment. Fenwick Elliott has been working with the Adjudication Society and the Chartered Institute of Arbitrators in order to produce a series of adjudication guidance notes. The first one, dealing with jurisdiction, has recently been approved by the Policy Sub-Committee of the Chartered Institute of Arbitrators and the Executive Committee of the Adjudication Society.

The purpose of the series of guidance notes will be to assist not just adjudicators but also parties and parties’ representatives in respect of the key issues that they and adjudicators face. To download the article click here.

Fenwick Elliott worked with the DRBF and King's College London to deliver the "Introduction to International Adjudication" - Conference 29 & 30 June 2011 in London. This conference was also supported by FIDIC and the Adjudication Society. The event brought together speakers from around the world to explore how the different types of Dispute Boards are being used and might be used in the future from both the users' and funders' point of view, the various procedures available and the procedural rules published by the main institutions, and the significant issues that arise in practice.
