Barry Hembling

Contract experience
Barry is experienced in advising on bespoke contracts and amendments to industry standard forms. Barry's non contentious experience extends to drafting and negotiating parent company guarantees, bonds, payment guarantees and collateral warranties with employers, funders, tenants, consultants and sub-contractors. He also advises on novation agreements, consultants' appointments, joint venture agreements, consortium agreements and general contract management.
Dispute resolution experience
Barry has substantial contentious experience and is familiar with all types of dispute resolution including litigation, arbitration, adjudication and mediation. He has advised on actions in the Technology and Construction Court and on domestic and international arbitrations. Barry's particular areas of expertise are resolving construction and engineering disputes, general commercial disputes and professional negligence actions. Barry has also been involved in a number of insolvency actions and is experienced in enforcing judgments in different jurisdictions. He also has experience of defending a contractor in a health and safety criminal prosecution.
Career
Barry trained as a solicitor at niche London construction firm Winward Fearon. He later joined the London construction and insurance firm Rosling King where he advised on a number of high profile multi million pound disputes. Barry moved in house in 2006 to become the Legal Adviser at Alfred McAlpine Plc where he advised all group companies on both contentious and non contentious matters and general risk management. Barry returned to private practice upon joining Fenwick Elliott as an Associate in April 2008.
Membership
Barry is a member of the Law Society and the Young International Arbitration Group.
