Eastern European rail contract dispute

A dispute arose, under an amended version of the FIDIC Yellow Book, on a project for the electrification and upgrade of a railway line. Fenwick Elliott advised the government authority and achieved a negotiated settlement.

DAB and ICC arbitration proceedings in Eastern Europe

Fenwick Elliott acted for a European construction company in a motorway building dispute arising out of the termination of a €52 million contract, which was based on the FIDIC Yellow Book. There were five DAB referrals and subsequent ICC arbitration proceedings.

There were a number of hearings before both the DAB and the arbitral tribunal (ICC arbitration), where Fenwick Elliott represented the client, the claimant in these proceedings.

Potential breaches of the procurement regulations

Advising a joint venture organisation, which was bidding for a major public procurement project, on the prospects of challenging that process.

Highway construction dispute, UK

Acting for a main contractor against a local authority client in connection with a £5million claim arising out of an NEC contract to build a new highway.
